    The problems with the 350,000 GC-candidates are mainly two - BECs inefficiency and lack of enough visa numbers after LC approval. Fighting both issues should be the main goal of IV and have to be presented to the Congress. They are inter-related and should go together.

    And, by the way, the problems of the legal immigrants should not be considered as "Indian/Chinese" only, this will not help much. These problems are common for the legal immigrants from many countries and this should be highlighted before the Congress. Do not forget that those congressmen are descendents of immigrants from all over the world, not from India and China only.

    Very sorry to hear this and our prayers are with you...hopefully all this will be settled soon and to your satisfaction.
    First thing - try not to stress out about this. Really, your baby's health and your own are far more important than some stupid GC. Keep in mind that the less you stress yourself, the more likely the child birth will go peacefully and well.
    Secondly, hire a good lawyer - it is well worth the expense and helps relieve your stress.
    Thirdly, if possible, let someone else (such as your husband) drive the "discrimination" lawsuit if you think it is fit...helps give you some line of defense against the problem.
    Regarding insurance, the employer must offer you COBRA. Also, not all insurance companies consider (or are allowed to consider) pregnancy as a pre-existing condition.

    Keep the good focus in mind - let not this affect your baby. And at the same time, don't leave any option unexplored. There're plenty of suggestions in this thread. Ask your lawyer which ones you must explore...

    And GOOD LUCK to you and your family! All will be well!

    A lot of people seem to be saying this. It seems e-filing AP usually triggers a new FP notice. If this true then it will certainly delay things. We would be better off filing AP by paper.

    What does everybody say?


    I don't know if this question has been asked before. Is there a benefit for filing AP by paper rather then electronically. I filed EAD by paper to TCS and got the "Card Production Ordered" email yesterday (in 14 days) for myself and my wife. My friends who efiled just received finger printing appointment notification and no receipts. Is there same benefit with AP? Please calrify.

    Thanks for your reply. Everybody else is just teasing and making fun instead of answering a simple question.

    (1) Are these steps taken in a sequence?
    (2) Does USCIS update the status of our file so that we know where we are i.e whether our file is stuck FBI Name check or FBI Fingerprint Check, etc..

    I didn't think my answers were making fun or teasing anyone - sorry if you felt that way, I didn't mean them to be interpreted like that.

    The main problem is that no one really knows for sure whether these steps are taken in sequence. There is little to no transparency. There are procedures, but we can not guarantee that they are followed.

    To answer your second part. No, I don't believe there are any standard updates that indicate this, but I could be wrong. I think that there is an update if you clear it, but not if you are stuck in it. Make sense?     To answer nlssubbu with the query about the "pre-approval" - I don't think it is a 1 time thing. Its a fairly standard USCIS practice. I have a link somewhere to the IO AOS processing manual. If I can find it I'll post it here.

    Do I think they have enough resources to process them all? Absolutely not, but I doubt there will be a rush considering PDs won't be current for a while (esp eb3)

    Talk to a lawyer and get the answers. But if you're on travel and questioned by immigration upon entrance if you're still working for sponsoring employer, depending on the circumstances, they can take your GC away. So that's another scenario separate from an audit or citrizenship interview that GC jeopardy may arise.

    If circumstances change, like you getting laid off or fired, that's a different story. If the sponsor's intent changes, and that does happen, then obviously, you're free to move on. But you should be able to prove that, with say a termination letter, for example.



    Many of us will be facing this decision and it's good to know the risks and the answers. Imagine you got a GC and now you have a +20k offer from the other company. Staying with your current employer for 6 months will cost you 10k. The question is "does the risk cost 10k?".

    This is how I see it, please correct me if I'm wrong. You can be questioned about leaving the company only in two cases: 1. citizenship interview, 2 - investigation/audit. In first case I don't see much problem, as many years will pass, and if you will not keep any documents, I don't see how USCIS will be going back and chasing these 4-5-6 months of your employment.

    Investigation is a different story. You have to be ready. The law says that you/your employer had to have intent to work on that position with that job description forever at the moment of AOS. Technically you could change that intent the very next day.

    So.. I think this is how it will work. USCIS might request evidence/letters from you/your "after-GC" employer and if they will find something like your resume that you have sent them before getting GC, then you are in trouble. But if you will demonstrate, that let's say you met your "after-GC" employer only after getting GC (let's say at some exhibition) and he offered you right away +50k salary, then I don't see how USCIS is gonna build their case.

    `(e) Inapplicability of Numerical Limitations- When an alien is granted lawful permanent resident status under this subsection, the number of immigrant visas authorized to be issued under any provision of this Act shall not be reduced. The numerical limitations of sections 201 and 202 shall not apply to adjustment of status under this section

    This ia a dangerous clause. So basically, an unlawfull alien residing in US for past 5 years gets change his status to PR, moreover he is not restricted by the per country limit he can go from filing I-485 to get a Visa number allotted to him practically overnight..and not having to wait like folks from India or China ....

    I dont think this bills has anything favourable to legal immigrants... It better to apply as the other category ....

    If your argument is that after holding a US Masters , OP will not be a legit EB2 applicant, even you are not legit. Go get some education

    Looks like you are also a candidate with three year bachelors degree and a namesake masters from US univ that you bought and which put you in EB2.

    Legit EB2 = GRE (good Score) + Toefl (good score) + Fulltime MS/MBA + Job in forture 500

    Not legit EB2
    1. 3 year degree from India + initial application in EB3 that is later converted into eb2 by buying a masters from some shady roadside univ in the US.
    2. bachelors + 5 years experience from some software company in hyderabad, as most people from there have at least 10 years software exerience even if they graduated 4 years ago.

    I am sure you fall in one of the two later categories.

    I agree. I personally wud never do that. i.e Why the hell should we clean the streets of an alien bcos thier system is broken? Thats my personal opion. Didnt mean tio hurt anybody.
    Like somebody pointed out, the move shud come from employers. Again taking leave etc for a day(bandh) is the not the way. The govt shud be genuinely convinced of the cost/benefits of ramping up or increasing visa numbers inorder to make any move. We should do stuff in that direction as opposed to expressing frustration.

    I am sure most of us here (especially from India) were pampered and did not even clean their own study desks or rooms of their house when they were young, now they are ready to sweep the roads of a foreign country to get the foreign government attention to get their gc :)
    Humans, listen, life is not 1000 years, it is very short, dont waste the best part of your life waiting for gc.

    How do you think the passage of the DREAM ACT could impact our situation ? If they pass this, they would allay a sizeable portion of illegal immigrants to get amnesty through their children (few millions). I am just wondering whether the illegal alien supporters would lose steam to support CIR after this ? Ironically, they would get a sizeable amnesty, overhelm USCIS with millions of applicants and probably make the passage of a CIR bill more distant. I can't think of something less advantageous to us than this. I hope I am totally wrong.

    What do you guys think ?

    Recent mid-term elections resulted in wins for the Democrats, who will take control of the U.S. House of Representatives and virtually the U.S. Senate as of January 2007. The ensuing two-year term, many believe, may be ripe for some sort of comprehensive immigration reform. President George W. Bush has been espousing all along the cause for comprehensive reform in this area. Most people recognize that there are immigration problems and governmental delays that exist. Most also believe that the system needs to be changed for the better. But just how this should be accomplished is not so easily agreed upon, and so it is a hot-button issue. Many of the hardliners, who took a strong anti-immigration position, lost the recent elections. But there are some who took this stance and won. It also is widely believed that many of the newly elected Democrats expressed anti-immigrant sentiments in their campaigns. Achieving any strong pro-immigration measures may prove to be more daunting than originally was anticipated; certainly more than many hoped it would be. Needless to say, we can expect 2007 to mark the beginning of a time for change and flux in the arena of U.S. immigration law. There is a possibility the DREAM Act could be passed, allowing the children of undocumented immigrants (who complete their high school educations in the United States) to obtain conditional "green card" status if they enroll in college or join the U.S. armed services. Both the Democratic and Republican parties seem inclined to help children. There are individuals, however, who are not willing to give any benefits to children of undocumented immigrants. Whatever the outcome, one thing is for sure – we can and should expect some debate on the matter of immigration law and policy in the coming year. Your input, therefore, is critical to the process.
