Thanks. That does help a lot. Once we receive the consolidated 1099 we complete the Schedule D (and D1 if there are more transactions than what can fit on Schedule D) and report the capital gains on the 1040. Correct?

Anything with the legislative effort aka unused visa recapture will not happen in this political environment.
My only question to the EB3I is,
Do you want to wait until the visa recapture, when ever it happens or will it ever?. More-over this has been taken up by many people in this forum and fizzled. To add more, do you know what will happen when un-used visas are recaptured ? Will it benefit EB3I or will it be given to EB2 just like the spill over. Would you do something right now to atleast get some short term relief to EB3I ?

Honestly I don't even see a point for these discussions, polls or predictions for EB3-I. The sooner we accept we are doomed the better. The only way out is to help ourselves but I don't think many EB3's are willing to do that.
I spoke to several in my office with earlier EB3 PD's (who might not even get GC's in the next 5-10 years !) and of course with EAD's and they have literally substituted EAD for a GC. They were once a part of IV (and some similar org's ?!) but now have completely lost hope and don't care. I tried to motivate them to join IV and support but they feel that IV does not cater to EB3's anymore. Sadly they are not even trying to port to EB2. They are just content with a job and EAD.
So, I am not really sure how many of us are actually willing to fight ?!
In fact it's even worse for people like me who are still waiting to file their I-485. Is it going to take us 5,10 or 20 years just to get an EAD ?!

also as far as comprehensive Immigration reform is consodered...I would say whether anyone likes it or not. Its just for votes (fight is so as to who gets thec credit DEMs Or REPUBLICANS). I am againsit as it promotes giving amnesty to illegals.

Guys,
Please give it a thought. What IV is doing right now for GC related issues would be more or less the same kind of agenda after most of the folks get GC and will be yelling at the processing times for Citizenship. I bet on it!
There is nothing wrong in thinking ahead of time and especially having the
process initiated and getting refined with the great folks we have here(ignore the ugly stupids who cannot understand the intent of this thread)

First of all...Hats off to IV for doing an incredible job !!!
My labor has been collecting dust in the Dallas BEC since 2001, my PD is Nov 2001, non-RIR. The online system still states that my case is in process. I am equally frustrated like all my fellow BEC victims, but I think there is no reason to feel left out or unhappy just because some people could jump the queue and get in front of us. The best we can do is congratulate them on their good fortune and hope that the DOL sticks to their deadline and clear all BEC cases by sep. If they miss the sep deadline (i wont be surprised if they do), I guess IV can help us in organising another flower campaign or a rally based on the recent success.
Lets keep the faith and stay the course !!!

It's hard to get a good idea when so few people participate in the poll so I took the data available on and ran a few numbers.

Problem being that last page of that thread keeps refreshing itself and everytime i scroll down to the bottom of the page it keeps going back to the top. Sounds like some script is running in the background.

Just happen to see some RoW EB3 cases at Nebraska center get approved.
One is RD 06/12/2007, which is a little bit more than 06/08/2007 on the Nebraska's RD processing annouced for 3/15/2007.
The other with RD 06/15/2007
P.S: The more I look at , I see there's even one case with RD for 07/13/2007
So it's possible Nebraska will move processing date forward to at least 07/15/2007 at the next processing date annoucement.

Where is famously liberal "lion" Kennedy in all this. He is the counterpart to Lofgren. When you are the chair of the subcommitte on Immigration you are supposed to be a leader on these kind of issues. Really disappointing.
