It is good to see lot of peopel of EB2 India are greened in the last 48 hours. However there is no single approval of people having PD earlier to 2004.
What it means?
Either one of the following should be true.
a) IV Tracker data of 65 pages ( 65*50=3250 approx) is wrong or Not updated
(Filtered by EB2 India Pending)
or
b) USCIS is processing I-485 randomly as usual , ignoring earlier PDs
IV Gurus / Seniors / Experts / Critical thinkers can comment on this.

I don't think the July/August filings will have impact on the retrogression right away. The cut-off dates would retrogress based on number of applications ready for approval/approved pending VISA number. The applications (485) filed in July/August are not processed yet and hence will not impact retrogression today.

The wait time for some people ran longer than a decade. In the meantime, these workers were trapped in "immigration limbo." If they changed jobs or even took a promotion, they risked being pushed to the back of the permanent residency queue. We predicted that skilled foreign workers would increasingly get fed up and return to countries like India and China where the economies were booming.
Why should we care? Because immigrants are critical to the country's long-term economic health. Despite the fact that they constitute only 12% of the U.S. population, immigrants have started 52% of Silicon Valley's technology companies and contributed to more than 25% of our global patents. They make up 24% of the U.S. science and engineering workforce holding bachelor's degrees and 47% of science and engineering workers who have PhDs. Extremely onerous bureaucracy – 10 years in US and no path to permanent residency (professionals, bankers, educators)
Indentured service
– workers cannot leave employer without facing deportation or illegal status
– including professionals
– employer holds too much power
– employees cannot complain or quit
– dependents must work illegally or leave the country to work
When people change jobs they often have to restart the process again from the beginning.
Solutions:
Canada example:
Permanent residency point system – points awarded for
- years legal residency (student, worker)
- family members in US
- education (more points for certain fields of study)
- proficiency in official language
- skill in high demand fields (petroleum engineers, medical doctors)
Work visas for dependents –
Eliminate restrictions on family members from working

“My family moved to the US in 2002. Before that, I and my wife were working in Malaysia. My wife has two Masters Degrees in Science. Once we moved in, I have been trying to get GC. All this time, my wife has been in H4. She has tried her best but could not land a job with H1 sponsorship as no company in her field that she tried is familiar with H1 process. All these years, she has been highly stressed due to this. People may think she must have known this before coming in. But, at that time, the average GC wait was 2 years.”
Other benefits of immigration reform to US economy
Stop reverse brain drain – US universities educate people who are often FORCED to take their skills out of the country
Support housing market – many immigrants hesitate to buy a house because of their uncertain status, but skilled immigrants tend to have healthy incomes that support home ownership.
Scrap diversity visa lottery
– does not attract skilled people
– Already have country limits for green cards
Why bring more people to US and then force people who are already here and have shown a dedication to the US to leave?
To prevent employers from abusing workers: Allow people who have work visas to change jobs without having to reapply for a new visa (up to the original expiration date) and restart green card process.

Backlogs in processing going back as far as 7 years or more: some have suggested that they would rather be denied a visa than wait so long. That way they can at least plan for the future.
Immigrants from most countries need to leave the US to get their visa stamped even when their visa has been approved and they are already legally in the U.S. The reason for this is unclear, but it causes economic hardship to immigrants who are delayed and risk losing their jobs.
Every year visas are unclaimed, often because of processing delays. Employment based immigrants have been asking for these unclaimed visas to be reissued to people who have been waiting years for their applications to be processed. The issue is reducing processing time, and they see visa recapture as a way to reduce the backlog.
Many immigrants have complained about the long time processing their applications for a green card. They would like to see automatic qualification for professionals who have lived in the US for a certain period of time (5 or 6 years).
Clearing the GC backlog and making it easier for skilled professionals to get permanent residency will encourage investment in US whether in the form of buying a house or setting up a business etc, because it allows immigrants to plan for the future.
Having no time limit for processing applications is inefficient and does not ensure accountability. Business projects and other processes need time frames to ensure they remain on track and that employees are productive. Government agencies need to be held to the same standards.
Applicants need to be able to access information about their status, which should have clear timelines for each step and show clearly where they are in the process. This is the only way they can plan effectively for the future.
Many people who have been in the US legally for more than 10 years but can’t get permanent residency. They are eligible for SS, but may be forced to leave the US with their US savings, assets and SS benefits. These people would like consideration of a fast track application.

No need to thank. Just show up in DC to community your GC problems to lawmakers. That is a big thank you to IV team in itself for all the time, money and energy we are going to spend organizing this event.
You will contribute for yourself. This advoacy day is for you and your own greencard. It is not a charity to IV. IV is you and me and we are only providing another avenue for each one of IV members to come to DC and tell lawmakers about the suffering they undergo during the greencard process.
I also have another suggestion. Why don't we also do a targeted campaign at partnering with corporate HRs to push for EB relief.

Incorrect. How can they be aware of any pain themselves? Has anyone even approached the senior management asking for help. Raely anyone has done that. And whenever someone has done that and help was offered , we have known. The fact is HR of big companies do not know of any pain. Even if they know of any pain, they will not do anything about it unless their OWN employees tell them about it and ask them to help them by supporting IV. This is not happening and that is the problem. IV is you and me and everyone else on this forum. Not just pappu or core team. Each one of us working for big companies need to gather courage and approach the senior management. It is very easy to comment on the forum and provide big ideas and direction, but I have seen that when it comes to walking the talk very very few have the will or interest to carry out their own suggestion. IV was created precisely for this reason. People were lurking on various forums before IV and hiding behind anonymity. They were scared to do anything and could only hope to GOD , lawyers or whoever could help them. Everyone was throwing ideas at each other and not doing anything. The whole community was screwed and nobody was even willing to even go and talk to the media with their real name, go to DC and talk to lawmakers on their own money and vacation time. People would not even open up to their friends and talk to their friends about green card problems and do something together. This community had to stop living a life of tail between the legs and blaming their fate for their own problems. IV is a platform where you no longer have to complain. Each one of us on this forum has now enough awareness, has seen what we all are capable of doing together in advocacy so there is no reason to not approach our employers.
These corps rely on EB2 and EB3 folks for innovation and technology. Corporations have a lot of power in pushing legislation.

The fact is, each one of us is capable of carrying out our ideas if we have the will to do it. This will happen only if we are sincere about this effort and really want to do something about our own greencard. If we all think that simply coming to a forum and posting some ideas or arguing with others over spillovers or predictions is all they can do, then we are all wasting our time, energy and money. There are many other sites out there where you can track your applications to waste your time. Or post unlimited ideas for nobody to work on or just argue with other. I agree too. Visa Re-capture is the only solution which is available at this time. Now we have actual data in hand. We need to build a strong case, for ex person with priority date of 2004 have x number of people ahead of him, based on the numbers available per year for EB3 (I) It will easily take more than 5 years, That means total time for GC process from start to finish is >10 years.
One has to work in similar position for 10 years.
We can brain storm points like this an d build a strong case for admin fix/ Visa re-capture...

All Spill over can do is barely move Eb3 from 2001 to early / mid 2002 that is all. So for folks post 2004 PD you are struck because by the time your PD gets spillover there will be EB2 I & C fighting for the same visa# that you need. So spill over helps a small section either Eb3 I with PD between 2001 - 2003 or EB2 with PD 2005 - CURRENT. For all others only real chance is recapture

Alright guys, I cannot tell you how excited I am to report that i got a call this morning from my attorney and my online case status also states that Card Production was ordered for my case!!!
After 8 long years.....i finally have been approved for permanent residency. After 7 years, i will finally, with peace of mind, go back to India to visit my family. Thanks to IV, everyone's help on these forums for helping me keep my sanity over the past 2 years....
After 15 years in the US, I will finally have my green card in hand soon.

I need to go to some place where I can spit out my frustration. This is just not done. Completely unfair.
With a user id that you have and your comment above :D, I think people might take you seriously. Take it easy buddy.:) I might not go to the mall today as I was planning to and stick to home.
Life has lots of other issues,so while the GC is important it cannot and should not come before all other problems in life. Talk to the people who have been diagnosed with cancer or something else and have been told that they will live 6 months at the most, you'll understand what priorities in life are.

Please continue your efforts. If you want to collect more money, then you need to send more emails. More and more members are needed as well.

If you really contributed $2400 as you say in your post and if you are really EB3 with PD 2003, then you wouldnt be asking others or me the questions. You didnt list a single action item that makes obvious sense to most people here.

Just one point Slumdog -- You know, I have never seen anyone who rents, writing this kind of a story and justifying his decision. I wonder, why not? Why do YOU have to justify over here? Are you justifying to others or you are justifying to yourself?
You put too much stress on "quality of life". One can have a good quality of life in a small apartment.
I keep telling my wife that our apartment looks small only when she goes to department stores and shops like crazy. Our walk-in-closet is the nearest thing to a Black Hole. Mass density is so high in that area that pretty soon even light would not come out of it.
I strongly believe in "Simple Living, High Thinking". I can not say I implement it all the time, however, I try to keep it in my mind during my decision making process.

I refuse to get caughtup in the consumerism. Why a family of 3 or 4 needs 2000 sqft of living area? The quality of living is not the top most priority for me. What I need is more important. When I am happy with a small car, why should I go buy a SUV?
Instead of paying 2000$ a month for mortgage for a big house which would consume most of my time as well, I can pay 1200$ month in rent , use the money to have some flexibility in what I want to do and use the extra time to read a book.
One thing I noticed is people will just keep running in circles regardless of how much they make . They have expenses in proportion to their incomes and they are in a way slaves of their lifestyles.

Agreed, It is very unfortunate for people stuck in backlogs and I feel your pain... But would you rather have seen USCIS waste over 40000 visas by the end of the year without any PD movement (as reported by some on this forum)? We would have had another thread here blasting the inefficiency and unfairness of USCIS.
Bottomline, I would not like to work in USCIS right now.. They are basically damned if they do, damned if they dont. That said, I do hope that BECs get their act together like USCIS is trying to and get everyones labor cleared by the deadline before the next retrogression hits.
I mean even if some of guys had their PD current, USCIS did not approve the I-485. They said that all the I-485's are preadjudicated but did we see flood of approvals....? NO... However, in either case, it is adding numbers of EB categories and hopefully rest of the bill is allowing for these numbers to fall across and down.

My Labor has been approved around May 20 2007 and my employer got a letter from DOL stating the same (dated May 23), but my Lawyer says that they never got the Original Labor notice (may be they misplaced it).
Now I'm waiting to file my 140 and 485 together before Aug 17 and he says if we don't have the original Labor notice, we can still file 140 and 485 with the proof we have (DOL letter to the employer).
Will this work or will my 140 and 485 be denied ?? I'm not sure I can get my original Labor notice before Aug 17. Is there anyway to track with DOL ??
