I wish they do the horizontal spill from other countries to India every quarter. This way the work load at the USCIS is steady. Instead they like to wait for the last 3 months. This does not give them enough time to process.

Come on.. we are not talking about hiring.. No company is waiting in line to hire anybody coming out from Aspen University with Masters Degree.
What we are talking here is whether One holding 3 yr bachelors Degree from India be eligible to apply under EB-2 category after completing Masters Degree from an accredited university.
If the PERM Job description says " Masters Degree"
GO home and stand in front of a mirror and ask yourself if your 3 year degree and a masters bought for 4k will get you a greencard in eb2.

These are not going to fix the issue at large about limited GC numbers.
We need to make sure bills like HR5882 get passed. So we need to focus on how to make this a central issue in current politics.
We need to do much bigger than a single day news ... something for which main stream media pays attention in +ve light.

This now will give me a 2 year EAD. and even after 2 years If I dont get a GC, I will be able to reapply for EAD, at that time WITHOUT any FEES!!
Not true! You will have to pay $340 or whatever the fee is at the time you renew your EAD again.

What if it is 3 + 3 ( 3 year Bsc Physics + 3 Year MCA) 10 + 2+3+3 = 18? I am wondering if USCIS would consider this equivalent to US masters? Came across a memo used by Nebraska Service center that says USCIS would consider 3+3 equivalent to US masters, but that memo was from 2006.
You are right -- 3 Year Bachelor + 3 year Master (in related field) is good to go. 3 Year Bachelor + 2 year Master is unlikely to sail through.

2 year back my I-140 got rejected due to same reason 3+2 degree. I have 3 years Bsc in Computer science and 2 years Master of Computer Mgmt. They raise the question on 3 year Bachealor dagree. My lawyer send the reply along with degree evaluation and we try to say my 3+2 equal to 4+2 of USA and USCIS didn't buy this argument. after that lawyer told me that no hope in MTR or appeal. So we file again in Eb3.
Now i see based on your reply if have taken this approach in appeal then i might have got approval in appeal.

I did create a poll to make a guesstimate of how many are ready to march in Detroit (when the weather was much better !).
Guess what only 14 members showed interest ! 14 members strolling down Detroit riverfront in freezing sub-zero temperatures - do you call it a rally?

When we conducted D.C. rally, there were roughly 1500 people attended. Each member has his/her own reason for not attending the rally.
The reasons could be, taking a day off from work or to far from their place etc..,
As a first step……..:)
Why don’t we plan for rally on the same day, same time at various major cities? This would enable members to attend in their respective cities.
We knew that, we are 25K+ members strong and can hold rallies/protests, where we have (major cities) at least 100+ members.
We must invite media and local US leader’s for rally and show our strength and request them to work towards the Green Cards.
Why don’t we plan for a rally during the this Christmas season?

This is indeed a gloomy and (in my view credible) story. The only thing possibly that can help us within the current laws, is the visa overflow from EB1 and EB2 ROW.

Like the other guy you said, I have an equity of 200,000 in one house and 50,000 in other house. I still don't have green card. I have around 300,000 in
401k and 150,000 in brokerage accounts. My net worth is around 800k, most of my money is in this country. If I want to continue my lifestyle, I need my GC, that will secure my right to live in this country. AFter 9 years of tax paying and law abiding life, I think i have a right to live in this country, but with this stupid laws don't know when i will get my GC.

As you have an urgent matter, you will need to expedite the process. The rules give government 60 days to respond under normal circumstances. To expedite, you will need to file a motion for preliminary injunction right after you file initial complaint. This way, you will get EAD in two weeks.

Some correction. 2 witness, one is a neighbour in another building. We live in 3rd floor, that woman live in 3rd floor on another building, there is one driveway between 2 building! Another witness is from leasing office staff, she claimed just near that area. That "help" is from that damn staff.
We only move to this apartment in 2 ~3 month, and both of us biz traveled lot, so don't think we bother neighbor much. And one of neighbor knew our miserable experience, he and his wife said would volunteer to support us in court if necessary.

First, find a new job and check whether the job would be the one which you would like. Get H1B transfer and move to the next job.
If i were you, with a lame excuse tell the present employer that you want to move to a another job because there is nothing challenging to work on. I liked working with you and i hope i can join you sometimes later. Praise him a lot so that he feels he had been falsely praised. If he starts talking to you about the contract tell him you would report to DOL etc..
I paid for my H1B fees and i don't care for paying the fees if i can get a raise by changing employers. This is my 3rd job and i had paid the H1B fees except one part the employer has to pay. (i.e. fraud fee, etc..) the lawyers fee is not required to be paid by the employer.
Forget of $3K, change the job and try to get 20% higher salary elsewhere a place you like. Its easy to get a new job with better compensation.
About my experience, I was working with a big desi company and they gave me 0.25% raise the first year and 0.7% raise the third year. When asked as promised when are you going to apply for my green card. They replied not this year but maybe on the 4th or 5th year because i am not fit to be a engineer. I left the company and found a small firm. I asked them to match my present salary and work on my green card. They promised me. (I like and respect Japanese onwers, they respect and treat better). They increased my salary by $13K in 6 months.
world is not small, you will find some better employer. Don't fight on small matters. Look at a big picture. Fight with your present employer only if you have no options. If you have options, cut your losses and move ahead in life.

From what I remember, when we wrote to President Bush, only 5000 letters were sent.
I dont think a number like 50,000 could ever be reached.
That's why we couldn't solve all the admin related issues then. If we had significant volume, we could have had visa re-stamping done in USA and the list goes on.. Any ways, I don't mean to give numbers.. But as long as we are on the same page that volume speaks and we don't have enough at this point of time, I am good.
We need a mass movement to make an impact. They need to get frustrated with the letters and will have to give a press statement that they are reviewing the matter. As long as we can do that. I think we can get DOJ attention. If 5K members send letters 10 times in 2 months, I have no issue, as long as we can annoy them with letters for justice..
