often times, i see that there are people who say India is getting better than US. Wages are going up. H1b is tiring. H4 dependents are not able to work.
but not once is the person posting the message declaring that he is leaving to India. He/She thinks that more "people from india will not come" . It is the person's ulterior motive that people from india should not come to US.
Actually those who have come here have invested too much time and energy and want to to go through the last few miles. Thats why they are not going back.
However the quality of students coming to US universities for masters in engg side has gone down a lot over the past 6 years or so.

AFAIK, Once you have a receipt number for 485, your 485 application will either be denied/approved. If approved, you will get your GC as a visa number has bee set aside. I 140 premium processing doesnt help you to get the GC by the end of the month.
talk to your lawyer to get the correct info about what happens with your 485 application with the retrogression of Schdeule A.

Guys if the employer's lawyer is not giving you information regarding the I140 and you are going behind their back for this information is it really going to help you with portability? It looks like they are just trying to make life miserable for you and what guarantee is there that they will not revoke your I140? I140 portability does not work if they revoke your I 140.

Change the language and target too. I am thinking to draft a letter to send Home Builder Assoc and Car companies that I am not able to buy Home and Car because I am not getting loan. I need a car and home as I am paying rent every month around 1500. I am willing to pay 25% down and have credit score more than 700. No any kind of violation. Paied off first car loan. I am experienced enough to find another job in such bad economy. The only thing that I dont have is GC for which I am waiting for last 8 years. If I get GC probably I will get good loan faster and cheaper. If you lobby for us for GC probably not only me many other immigrant will get loans.
Never ever mention that it will improve economy.

I like this idea of getting assistance from lobbyists in HBA and other assoc. They already have established their presence in Washington. If we can sell them this plan, I think something can be done. We need a horse to ride to DC.

I have watched it a couple of time, though not a regular. No chance of getting there unless you are celeb fresh out of rehab and/or facing midlife crisis, divorce etc., or a US political bigwig.
We are none of the above.
Looks like we need to catch hold �Larry King�. If we can project our Green Card issue through 'Larry King', then it would easily catch US National attention.
Can some one throw ideas on this please?.

My wife has a H1 since oct 2006 till date she hasn't worked and hence has no pay stubs. her passport has a F2 visa. I want to convert her visa to H4. Her employer is asking for 6k to generate 3 paystubs for 3 months. I dont want to pay so much. if we go to canada to get H4 stamping will they ask for her pay stubs or just my pay stubs are enough.
Is there any chance of rejection. also can I go to canada for stamping or do i have to go to home country.

Do you want to apply for a GC in the future ? If yes, then aren;t you happy someone is paving a way for you ?
I haven't applied for green card yet. Is IV only for GC purposes or it addresses other issues too which makes life of H1b holder hell?

If you had received a denial of your application for example not having the same designation/ different salary/different location etc... please contact and we would like to assist. This would also help us try solve the larger issue of restrictions on applicants during their greencard journey where they are bound with employers, salary, designation, narrow occupation field etc.

Two years before you would have got a different reply because selling a house was easier than now. My priority date is Jan 06, EB3-I, but we bought a house because of our personal choice. We wanted to give our daughter a nice environment to grow with friends. Why should she suffer because of the delays in GC?
Not buying a house doesn't hold you up to a location, especially if you are in consulting but again if you want to settle down and travel less, with EAD, it is still OK to buy a house. As long as you have some saving to take you through just in case you have to go out of the country and come again, you should be OK. If you don't want to risk it and space is not a concern, renting is not bad at all. House in the US according to me is not an investment purely on dollar value but the quality of life is way better than renting. If you will lose sleep just because you made a major investment, then hold on for few more years.

As long as the employer/employee relationship exists, an H-1B alien is still in status. An H-1B alien may work in full or part-time employment and remain in status. An H-1B alien may also be on vacation, sick/maternity/paternity leave, on strike, or otherwise inactive without affecting his or her status.

Sorry to hear about such cases. We all have to realize one thing here. The employers need us equally bad as we need them (more often than not, not talking about Indian consultancies here). If ever one encounters such racial discrimination and open abuse at the work place, the best recourse is to file a complaint with the higher ups in the HR, start searching for another employer and ditch the current racist employer at the right moment with an appropriate email sent to everyone detailing why the person is leaving at such an important phase of the product development. Yeah, this might sound un-ethical, but sometimes situations do demand such drastic measures to send the right message. That's when all these racist employers would realize the importance of the person that just left the company. Then they can try to fill in the position with their preferred race qualified person and see how difficult that gets!!
Better still, please talk to your friends and family in other parts of the US and find the areas in the US that are cosmopolitan and try to move to those places. Yeah that is very difficult in the short-term, but in the long-run, you would have peace of mind and a good quality of life after making such a move. Fortunately, i am in the Bay area and i have rarely encountered such racial prejudices out here. Just my two cents.

I thought of leaving this company several times, but I am working in this company for 6 years and the only company I worked after coming to USA. I invested so much for this company, like working beyond work hours, working in the weekends, making up the project deadlines for the incompetitive colleagues etc. etc. and now just waiting for my Green Card. There were so many times I thought if I get my Green Card I am going to leave this moment. Years passing by and with this retrogression thing, there is very little hope of getting it soon...
The positive thing is, my direct supervisor is very nice and I can voice my opinion and she understands me and completely supports me. I am just praying god that I should keep working for her till I get the GC.
Better still, please talk to your friends and family in other parts of the US and find the areas in the US that are cosmopolitan and try to move to those places.
