If you don't need EAD to use AC21 whats the use of EAD for the primary applicant?
I was not planning to change company and just filed my 485 without EAD last week. But now situation has changed and the lawyer said i need EAD if i want to use AC21 after 6 months. I'm hoping to get a receipt notice soon so that i can file for EAD without the increased fees. Anybody has any link to where it says we don't need EAD for AC21 so i can check with my lawyer?

AC-21 can be invoked on H1 as well as on EAD. Your choice.
Many times, joining second employer is relatively easy on EAD as it involves no H1 filing (less paperwork), but using EAD requires one to travel ONLY on AP.
Using H1 is more peace of mind. If for some reason I-485 is denied, one can in US (and work too) until H1 status expiry date and handle appeal more effectively.

AC21 can be as safe as a any normal 485 case so do not worry. Its classic case of USCIS ignorance on AC21. I would say, hire a good lawyer and prepare for a MTR. I have seen Ron Gotcher as a very prominent proponent of AC21 rules. You can take his help. I used AC21 and got GC approved without any hiccups. My case was handled by Ron and I have been completely satisfied with his services.
PS: I am not affiliated to Ron in any way. This is my personal experience.

Shirish has a very valid point. I think it should be six months after I-485 application as pointed in AC21.
I think the 6 months period should be counted fron the RD on the RN for you I-485, else AC21 and this " propoganda" contadict each other.
If you get your GC with in 6months from the RD then stay untill you finish 6 months (this is very unlikely to happen as it takes lot more than 6 months)
If you get the GC after 6 months i think you are fine.

My first PERM (through company A) was denied, as I told before, just because the PERM software automatically denies application with requirements that exceed "normal" SVP level. (Moreover, it accuses you in claiming that the requirements are normal, even if you didn't claim that!) I am not preparing a second appeal. I am preparing a second PERM filing through another company.
I couldn't really find any information about the appeal process on the LC once it is denied. the ironic thing is that my first LC was approved then after I got promoted to a senior position and applied for a second LC, the 2nd LC was denied because they think there is no difference between the 1st and 2nd position. does the DOL have an automatic system that processes the LC and that why it coudn't see the difference between the 2 positions??
where can i find more info about the appeal process?? any links to go to??

Yes. That is exactly what happens. Everytime a cut-off date advances in a certain category, a sweep is conducted of all previously submitted I-485s, and either continue their processing, or if processed far enough, approve it. If a category retrogresses, processing on the case may or may not stop, but APPROVAL IS IMPOSSIBLE if the PD is before the cut-off date.

Yes, it is exactly the same. And that means their processing STOPS before approval. The 50,001st schedule A, submitted in, say, June/July/Aug 2006, will NOT be approved until her EB2 or EB3 PD becomes current.

Well, that is what happens. For example. My PD became current with the release of the Nov 2006 bulletin (I have submitted my I-485 3 years ago, and have had 2 sets of Fingerprints taken). Processing was completed on my case over a year ago, but I could not be approved until Nov 2006, because of my PD.
If, god forbid, I am not approved in November, and EB3 retrogresses back 2 months, I will once again be stalled.

They are talking about Both H1b and Green card. Corporations are pushing for increase in H1b also. But this time they are giving some importance to green card also. That is a good development. Already Skil bill by Cornyn is there. May be in next few weeks it may come for voting with or without attachment. But approximately 4 to 5 votes will decide the fate of the bill as usual in the Senate. And also as usual anti immigrants may push Durbin Grassley bill. We will wait and see.

Alright, enough of beating you down. Now if your crime was adjudged civil infraction, I won't worry too much about it. Civil infractions are leinennt, but you are now all set for rest of your life to be in public records. Future employers and creditors would see that too when they do background checks. Other than that you got nothing to worry about. Go ahead and continue to plan for your India visit. But may I advise not to indulge into that habit of shoplifting? ... uhmm I know gifts can be very expensive.:cool:

I almost didn't bother reading this thread; thinking people were just beating the horse shit incident. Can you say something like HR5882 rescheduled to Sept.23rd?
Sorry folks for creating one more thread...But i think its time to get energized again and start afresh( some people might not be looking into the IV call campaign...becuase of too much depression..resulting from the HORSE discussion last week in the senate..)

But the thing is how i am gonna prove that i am paying money every month $500 for my H1. In my Pay stub they are saying "CASH ADVANCE DEDUCTION" = $500
