    I agree with you.
We do not have to go and sit down in their helluva offices to figure out what the heck is going on. My point is simple. As long as all the so called companies simply write software, provide services to US companies its back office. How much of software written is for native use? How much of the revenue generated by these companies is Indian based? With out infrastructure and manufacturing growing at at least 10% of the other growths people dream about, its nothing but a deck of cards doomed to fall any time. Enough of my rant.

My understanding was that once the 485 is filed, you go by RD. It doesn't matter what your PD is...

Does anyone know what the legislation is?

I don't think so. Your PD is still relevent. Only those people whose PD is current will get their GCs no matter what the RD is.

I wish they hadn't closed the blog, I wanted to post on there. I don't see any posts on the link you have provided for the H2B blog on WSJ. Am I looking in the right place?

Honestly, I am tired too. I have canadian PR but I am not even sure if I want to go there now and start afresh there. Maybe I should think about semi/retirement in India too.

Gar Gar ki yahi kahani, ( it's typical story for any immigrant family),

main issue for us now we had invested so much time on this f** GC, we can't bail out now, feel like we are so close,

for myself I don't have that much energy left in me to go back to start allover in India, worest case scenario I just want to stay couple of more years and save as much as possible and go back to India for semi/retirement

Thanks for clarification. I still disagree with you. Media outlets do measure the intensity of the issue but not by amount of SPAM they receive in e-mails. From my personal experince in talking to a journalist, if you send them an e-mail regarding the issue they have published they will definitely defend their point or refute yours and may even look at the issue from your point of view but in all cases they will reply. Now if you want to bring an issue to their attention all you need is take their article and simply put your perspective on it. It will have a far greater impact if it comes as a collective voice of an Organisation such as IV. That's why I originally questioned our approach of spaming them by sending 1000's of e-mail with the same issue. It doesn't bring much to the table. Right ? That's precisely the reason why all organisations have a media relations person who represents the collective view of the entire organization and manage the press releases and all contacts with media.

Tell me about getting a response from reporters. It all depends on their whims and fancies. If they want to write, they are after you. If they dont want to they evade your emails. You have already considered our emails SPAM :) Thats what it would be considered if a bunch of people send the exact same email body. If we do send different message, it might still occur to them or a click to these forums will make them feel that we are trying to get more media exposure. What if the reporter you are writing to has an opinion similar to that of Tancredo on H1B? You are talking about taking an article and putting a perspective on it. Can you be more elaborate? If you are talking about articles being written on us, I believe there are not a lot. How ever there are talk shows that go into every home in the country that do propaganda work. For example a reporter at NPR replied to my email, how ever she doesnt revisit any story atleast for an year. I agree with your idea of Press Releases and I believe it was discussed before. I believe Pappu is working on it and I can do any help needed. How ever, I do not agree that we will be considered SPAM unless its the same message COPY/PASTE. 1000 emails?? Are you kidding me? I am sure it hasnt gone beyond 10 and will not go beyond 25 in the worst case.

If you dont believe what I am saying try contacting the local radio/tv station and see how you the thing works. What you are talking is IDEAL, But we dont live in one. Do we?

I got a reply for these letters from my local Senator. She just said thank you for expressing my opinion about this bill and she gave me the latest status on it.

    Thanks.

    Who is your local Senator?

Solution is give away GCs to all pending labours/140s/485s. Then nobody works for lesser wage and so we can equally compete with US citizens. They created this mess and so their fellow citizens are facing the problems.

Also, all anti-immigrants are publishig the wages mentioned in H1B LCA's when comparing the salaries with US Citizens. But thats the wrong approach. Employers always mention the minimum wage that can be given in LCA while applying for H1. But the actual salary is always more than that 90% of times. So, these anti-immigrants don't know that actual salaries paid to H1B employess are far better or equal to salaries given to them. So, thats what they are crying. Also, they are crying because of they are not able to copeup with the technology changes and compete with us. Employers put the minimum allowed wage because of avioding high-pay when the employee is not productive or not on project. So that they can pay the minimum wage as per rules.

If there is a free flow of immigrants, why the wages will go down? These are all because of corruption at govt side. So, do not blame H1Bs. They came here all the way crossing thousands of miles, leaving their parents and in-laws for the sake of getting better life. This happens everywhere and everytime.

Also, when we say immigration system is broken, it doesn't mean that it is completely broken and replace with a new system. Just increase the EB and FB caps and per-country limits. thats it. It solves the problem. Do not revamp whole system. Existing system is fine and only thing is not enough visas available as per demand. So, solve problem by correcting it. We need to convey this to senators.

Finally, there will be flaws in any system. With that some people has to suffer. But if majority of them doing better and contributing to the economy, that will be good. Do not care for those few people, and destroy the lifes of majority of people.

    God bless america.

I have been a big fan of IV and have been a visitor to IV for a while. I now plan to become a volunteer and join my state chapter and also contribute in all possible ways to IV because I think IV is the best thing to happen to this community.

Dear gurus - here is my issue and I need some real concrete help.

I was working for a New Jersey based consulting company on a percentage basis ie 80/20 and all costs towards GC and h1b were by me. I found my own projects and negotiated my own billing rate.
I worked for this company for 3 years and filed for 485 in July 2007. I am EB2 India with a priority date of March 2nd, 2006. My 140 was approved in June, 2006.
In March, 2008 my project got over and I started looking for new projects. Market conditions forced me to take up a fulltime job using my EAD and I had to move into a fulltime job.
As it is safe past 180 days, I used AC21 portability and moved.
I had been having excellent relationship with my desi employer and in fact also payed up some money to the employer because the client did not pay for last 2 months of my project and my desi employer held me responsible as it was me who negotiated with the client and said it is my issue - for which I agreed.
I already sent a AC21 letter to USCIS through my Attorney - I am not sure if my file got updated.
My desi employer wants to withdraw the 140 petition now. He says, he cannot keep 140 petitions of employees who leave the organization and not on w2 and he will have "ability to pay issue"
I have heard horror stories of USCIS issuing denials and NOID because AC21 letter never reached the file even though it was sent in time and I guess this is exactly what my desi employer thinks - teach lesson by withdrawing 140.
I spoke to my Attorney and she says "your file may not be updated but we will keep a record that we sent" useful in case we want to respond to NOID or RFE.
Folks - please post your AC21 success/horror stories when previous employer withdrew the 140 petition.
What are my options to avoid a NOID or denial
    Thanks in advance

I am in a similar situation , though not exactly the same. In my case I was laid off and my company is going to revoke the I-140 because the position is not there any more. I pleaded them not revoke the I-140 but they said they have to withdraw it as they do not want any liability. My company has about 30,000 employees. I also have the same question as to how I should avoid NOID or denial.

I have seen lot of people switch using AC21 but most of their employers do not revoke I-140. I have yet to see cases where a person's I-140 was actually revoked after 180 days and they were still safe and got their GC approved.

I am not sure about this but one thng can certainly happen with Admin Fix.
Porting of applicant who have stayed long enough in (EB3 to EB2). EB3 15 years experience and still counting and stuck and uncertain porting rules and AC21 doesn't make sense at all.
    Or
AC21 rules or some other fix giving relief to people stuck in GC unnecessarily.
USCIs can make these fixes but they dont want to do it. Its simple

..and why not EB2 to EB1 and EB1 to EB1-NIW..and so on...

I am thinking of buying a home without waiting for GC approval. Just want to see the trend....

Please vote yes if your GC is pending and you own a house.
Please vote no if your GC is pending and you are renting.

Honestly, you do not need a poll to own house, it is a personal choice.

I and many folks in this forum have seen very few approvals for this category. How come USCIS says that this category is over subscribing the visa quota. Why they are moving un used visas to EB2 (no offense) why not for EB3?

We need IV help in this area.

    Dear Aman,

This letter is regarding the article "Say it with flowers: Gandhigiri for US green cards" published by the Indian Express on Wednesday, July 11, 2007. The article erroneously indicated that Robinder Sachdev from USINPAC was a coordinator of the flower protest initiative. As you obviously know, this is incorrect. I assure you that Mr. Sachdev did not make this false representation. We are reaching out to the reporter requesting they publish a clarification. USINPAC is aware that the flower plan was originated and organized by Immigration Voice and has responded to all enquiries accordingly. Please feel free to call (202-276-7946) or email me on this, if you have any further questions.
