If you say we are paing taxes so we should get greencard. That does not make sense. We are using roads, hospitals, infrastucture of this country and we pay taxes as long we live here.
If you say we invent new things, start Google etc then these people qualify for EB1 and it is always current.
If you say we have USA masters then we can apply in EB2. EB2 will get current next year or its wait time is going to decrease and will be 2 years max. So 2 years or less is a reasonable processing time within a 6 year H1B processing time.

From my side, I have done a little bit - contacting law makers, sending letters, contributing / collecting amounts from friends for advocacy...
I work for a large corporation and did talk to them seiorusly. They expressed their sympathy :) :) :) Nothing more !!!

I know people who had to separate from their families and send their familes to India as they could not afford paying International tuition fees which is about $ 45000.00 per annum.This solely affects Indians / Chinese. This literally makes you an outcast just because you do not hold a GC! Just think of some of the hardships people are facing.
If people from EU were to be back logged like Indians / Chinese, things would have been different!

Now that we have you, i am sure you would help in this effort by sending out emails yourself and also other members can join you to contact media. Is there any Specific date, I mean when AILF is filing the case...USCIS is announced they are gonna reject the applications..but did they rejected any single application?? We will come to know after 4 or 5 weeks abt our applications (As per USCIS rep)....I think there must be some time limit to file a case...and we dont have a base to file a case until they reject it.
Finally they dont reject application nor they will accept it...

Like RAgz4u said, with a tight rope walk, it will be extremely difficult to get our amendments to pass.
Without that, even if the bill pasess and lets 12 million undocumented
folks get in the line, it is drastically going to clog USCIS which
may screw us up badly.

great work everyone. thank you nycgal and others that took initiative and pushed this effort further. committed members like all of you in this thread help us a lot by sending emails to reporters. several letters highlighting a particular issue generates interest in reporters and media orgs and they choose to write about us. It is not easy to get even a single article published in newspapers and it is due to the efforts of our members, we are able to generate awareness. There is still a long road ahead of us and I am sure with active participation from everyone, we will surely succeed.

Go to the Trenton DMV . Take your ORIGINAL receipt and a letter from your employer . They will give you extension for 240 days . I got it done in May 2007.The draft of the employer's letter is as follows

Send email to who ? Can you pls describe in detail what email they need to send and what reason they need to put in. My local office always says NSC is processing July cases so you should have it soon, but that "soon" has never happened. It is 160+ days since I applied.

As you Said God means different to different religions followers like for Christian God means "Jesus" Hindu God means "Shiva/Vishnu/Bramha ..." for Muslim "Allah" , But the Word is Still the "God".
For them "God" is the one that has created this world , for you its nature that has created this world.

not to be pessimistic, nov 3 is really close and I am thinking it may not happen. Here is what i have done and am planning to do..my recd date is july 30th and my travel agent is nov 21st.
1) already expedited the cases by phone.
2) just faxed the letter to local congressman.
3) have an infopass appt for the end of the month.
4) have a letter ready for the ombudsman, will send it right away after the infopass appt.
Doing all this, i am still not sure if I can make it to this trip or lose $1800 by cancelling my tickets.
Me too !! My ticket were for Nov 3 and i am waiting for the last 54 days ..just requested USICS to expediate the AP based on financial loss ...

I do not know what level of education you have achieved so far in your life but it looks like you are not enough educated to differentiate between the definitions of permanent residency, citizenship and perhaps working on work visa as far as legal stay in USA by outsider is concerned.
What would be the "legal" reply from US Supreme court,if you ask US supreme court that whether citizen of other country can call US president a "My president"? . And What would be the "legal" reply from Supreme court of country A,if you ask that whether citizen of country A can call US president a "his/her president"?

And what is expected legally is one is not involved in "Anti USA" activity whatsoever it may be.USA legally never expects citizen of other country "to love" or "show fidelity" towards USA when s/he is still the citizen of other country.

USA and its whole society is well aware that these persons are citizen of other countries and so they never expects any kind of fidelity from them at least "legally" and at the same time they even do not grant the rights what US citizen nornmally have. Now out of that bunch many people prefer to go for permanent residency as permanent residency bring little bit stability in living and flexibility in employment and international travel. If one becomes a permanent resident of USA then also USA still only expects that person abide by the law of the land and do not involve in "anti USA" activity. It still does not expect "fidelity" towards USA in legal sense.There is no legal or social or political or any kind of pressure from USA or any governmental or non governmental institutes within USA on any particular person coming from other country to become its citizen. My PD is september 2006, I140 approved, DS230 approved, 3 packet approwed or not ( I am not sure, accordig to the last reply from the attorney my case could be even in the consulate), Before the retro began my case used to be a subject for schedule "A"( nurse), now I am in EB3...
The question is - will I receive my appointment to the interview soon(next month), because all forms have been accepted already, or I have to wait for all cases with PD older then mine to pass before my case???
One more question.
I am not in the US. Should I try to go to the US, and then(after 2 months) apply for I485, before the retro will start again in september??? Is it necessary to have I485 approved in order to receive legal status or it just have to be filled and applied? Will I lose my place in the consular processing after applying for the adjastment of status?
I know , too much questions, sorry for that but I am realy confused, and badly need your help and advice!

Of the hundreds of thousands of July 07 filers, who paid a mere $325 for their I-485 application, do you think USCIS will devote the time/effort to constantly keep track of the applicant's eligibility of 485 over the next several years???? It will take atleast 4-5 years for several of us to finally get a visa number. Several of us will move/have address changes during these years.
It took them 2.5 years to process these...imagine the nightmare if they were to try doing subsequent rounds....
Keep in mind that 485 eligibility is not just tied to employment but also FBI name checks etc. Do you think USCIS will keep on doing name-checks every other year, or issue EVL's every other year if/when they see for instance, an address change?
Dude...USCIS is already on its way of bragging to the congress that it has pre-adjudicated all these 485 applications. I think if they touch these pre-adjudicated applications, then someone has to answer to someone of what is going on...why haven't you still worked on this? why are you devoting your time to these old 485 applications when there are new ones yet to be processed.
I think once the application is pre-adjudicated...that's it!! I don't believe USCIS will spend anymore time and resources to these applications again...until a visa number is available from DOS and they apply the number to the pre-adjudicated application....my 2 cents!

`Sec. 245B. (a) In General- The Secretary of Homeland Security may adjust the status of an alien to that of an alien lawfully admitted for permanent residence if the alien--
`(1) was physically present in the United States for a continuous period of not less than 5 years immediately preceding the date on which this provision was enacted and has maintained continuous physical presence since then.
This if i am reading and understanding right may not be too bad. Let me kow if i am missing anything......

One interesting point that came out of that recent hearing.
PD movement results in both 485 approvals + new 485 filings. CIS blames backlogs partly due to the policy that allows 485 filing whenever PDs are current. if PD movement results in 5 approvals, it also results in 10 new 485 filings and thus a backlog is built over which they have no control.
So in their opinion, PD movement should only control approvals & 485 filings should be controlled separately. If this happens, there would no backlogs and no one will ask them any questions or drag them to court for hearings!
