Enough is enough. I am ready to sign this.
I have 3 real names. All were working for Cognizant. One had 3 years of exp. Cooked up with 4 years of B.Tech and totalled it as 7 years. Came on L1 as PM and applied in EB1. He got GC in less than 1 year. Other 2 had real 7 years exp and got GC's in 8 months. All were working at Client's place and NOT intra company transfers.
I am not selfish. But I am sure this guy with 3 years exp may one day become a boss for any of us.
This misuse will hurt the genuine cases. Shall we we go serious and complaint? I am ready to sign and submit all the proof.

A good formal education is always desirable. I have no problem with that. What I take objection to is this entitlement mentality of some folks. A degree does not entitle a person to anything. We all had a sigh of relief when we saw the new labor certification process (Perm) and were promised that it will be much faster and smooth. Thankfully they have kept their promise, for the most part, except for the cases that get audited.
The cases that are 'randomly audited' have been pending for months and months, some cases () have been pending for over an year and there have been no response from DoL what so ever. I understand that a year does not sound bad especially to those folks who had their labor approved through the old process but these days the labor is getting approved within 50-60 days (average). It appears that the DOL (Atlanta Processing Center at least) does not bother to look at the documents once the audit has been replied to.
Although I understand that not everyone uses and some audit replies may have been replied sooner and were never reported to but you can get the idea just by a sample of the cases that were audited, and see that they have being neglected, ignored or appears that they are no longer considered for further processing. I have seen instances where the lawyers have retreated the application in the audit and filed a new application (a gamble) hoping that it does not get audit this time around. But not sure how that turned out.
If you visit the Atlanta Perm section on you will see the people's misery I mention here. In fact, I am sure that there are number of IV members who are going through this aggravating process but are silent becuase they know that can not do anything. Even lawyers have shown the sign of disappointment to this hopeless condition.
So I ask you, Members of IV, to help us and suggest something that (we) can be done to bring this to the attention of some sort of authority that would help trigger the review of Audit responses.

As of now we are gathering people here to estimate how many people are out there suffering the delays caused by Perm Audit. I have added a poll which is a way for us to estimate the number of people who will support any action that we take to make our voice heard.

OK I'm from RAW EB3. PD Apr 2003. 140 and 485 were filed concurrently in June 2004. I 140 was approved in 1 week (I guess because my son was aging out) and I-485 for all family were approved in June 2007.

Has anyone asked attorney whether we can write our case number on the complaint letter without asking employer since LC(PERM) is filed by employer and the case number seems to belong to employer.
My HR and company hired attorney are always not cooperative to my GC and I want to clear things.
Don't take my question negative. I am fully supportive this 100% and appreciate guys very much. I am happy that we are doing something to make things better.
My attorney does not recommend sending letter to the DOL. Attorney recommendation is that benificiary should have no actual involvement in the labor certification process. If we get involved in the the process, it could result in an adverse impact on the process.
Based on this I am not sending the letter.

Unused visa for ROW (Other countries) is NOT because there are not enough skilled workers from other countries but because the uscis/dhs use the quota to conservatively hence at the end of the visa year there are still many quotas left. ROW priority date has never been current for a very long time

Chaya, We are going back to India on personal choice. My manager here knows very clearly that I cannot take up promotions and the HR does not want to do eb3-->eb2 conversion. So, I took up this crap for a while, and decided to put an end to this misery once and for all. And fortunately the same company is offering me a job in India at a good designation with good compensation. Also, we were missing out (esp my kids) were missing out lot of things happening in India, which they want to be a part of. Original idea was to stay in US for 10 years and go, only difference is now, we did spend that 10 years but still dont have our GC. Another important thing that we considered was , it becomes more difficult to take this decision when we have GC in hand because, as much as it helps to stay in US, it avoids us from leaving US too, and to wait for citizenship is another 5 years from that point, which could all take easily 6 years to the minimum from today. Thats why we wanted to make it easy on us, and do this now.
Looking back, would I re-do this GC process one more time - no, but am I happy to be a part of IV - you bet I am. Thats the bottom line.

People who haven't even started their green card process yet can buy a labor from any bodyshop, use it to file their 140 and 485 concurrently and get a foothold in the great american GC mela. Howzaat.

i had pleasuer to meet with aman/logic life/paskal/pappu. it made some good sense to put a face with the IV handle and it does helps a lot.
over all my experience was that all members (core and non core) worked earnestly to make anything and everything possible. i know it as i was outside the room where all the action was... and could see honesty in every action.
this will go down as long lasting memories with me...

I efiled the EAD application and in the confirmation page, I got instructions to mail supporting documents to NSC. I mailed copy of the efiled receipt, copy of current EAD card which expired end of July 2010 and a copy of I-485 receipt.
My question is - are things different for efiled applications?
